These Terms and Conditions apply to the DeLoire website located at www.de-loire.com and all affiliated websites linked to www.de-loire.com by DeLoire s.r.o., its subsidiaries and affiliates. Please read these Terms and Conditions carefully (hereinafter referred to as the “Terms and Conditions”). BY VISITING AND/OR USING THE SITE IN ANY MANNER, SUCH AS TO LISTING PRODUCTS OR PLACE AN ORDER, YOU AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS. Please read these Terms and Conditions carefully. If you do not wish to be bound by these Terms and Conditions, do not access the DeLoire.com site.
Change of Terms
These Terms govern your use of and any purchase made on the www.de-loire.com website and constitute an agreement between you and DeLoire. DeLoire s.r.o. reserves the right to change or modify any of these Terms or any Site policies or guidelines at any time and in its sole discretion. Any changes or modifications will be effective immediately upon posting of the revisions on the Site. Your continued use of the Site following the posting of any changes or modifications will constitute your acceptance of such changes or modifications. If you do not agree to the modified Terms, you must discontinue use of the Site.
Trademarks
DeLoire, the DeLoire logos and any other product or service name or slogan contained on our Site are trademarks of DeLoire and/or its licensors and may not be copied, imitated or used in whole or in part without the prior written consent of DeLoire s.r.o. or the applicable trademark holder. You may not use any meta tags or any other “hidden text” utilizing “DeLoire” or any other DeLoire name, trademark, or product or service name without our prior written consent. All other trademarks, registered trademarks, product names, and DeLoire names or logos displayed on our Site are the property of their respective owners.
Product Availability
Occasionally, you may be able to place a product in your shopping cart and submit your order for processing, but your order is subsequently canceled due to product unavailability. You acknowledge that products may sell out quickly and there may be a short period after your order is submitted but the product is no longer available. You agree that we may cancel your order after you receive an order confirmation without penalty.
In very rare cases, you may receive a shipping confirmation from us, but the product is no longer available in our inventory or the inventory of a third-party fulfillment provider. You agree that we may cancel our acceptance and cancel your order without penalty if we are unable to ship the product you have ordered due to unavailability.
If you are interested in a piece of jewelry that is currently on backorder, please email us and we can let you know when the item will be back in stock. Sometimes with the volume of orders we receive, an item may be out of stock before we are able to post an announcement on the website. If this occurs, we will contact you directly to discuss possible options.
Pricing
Our prices are also subject to change without notice. Please feel free to contact us with any questions. We do not negotiate on the prices of our products. All our prices are final.
Product Cancellations
DeLoire reserves the right to cancel products or services to any customer at any time for any reason. The customer’s sole remedy in such cases will be a full refund of all funds we have collected in connection with the cancelled products and/or services.
Payment Information
After you select your jewelry and provide shipping information, you will be prompted to enter payment information, such as your credit card information and any promotional codes or gift cards. By entering your payment information and submitting your order, you authorize us and our third-party payment processors to charge your selected payment method for the amount of your order.
Comparison Shopping
We do not permit comparison shopping. Comparison shopping is the act of purchasing several items with the intention of keeping the one you like the most and returning the rest. This will cause unnecessary restocking and inventory overhead and can be very costly. To confirm the quality of the jewelry, please contact us and we will be happy to assist you with your selection.
Severability
If any provision of these terms and conditions is deemed unlawful, invalid or for any reason unenforceable, that provision shall be deemed severable from these terms and conditions and shall not affect the validity and enforceability of any remaining provisions.
Ordering Terms
The contractual relationship between the buyer (as specified in the order) and the seller DeLoire s.r.o. arises upon the order and the selection of the payment method. The buyer is obliged to provide all information in the order truthfully. Incorrect or incompletely specified information by the buyer cannot be accepted as a reason for a complaint later. Carefully measure and specify the size of your fingers according to the EU size scale. Complications may arise as a result of later modifications to the rings. In particular, with the alignment of stones, surface treatments, etc. In some models (especially with the placement of stones around the entire circumference of the ring), it is not possible to adjust the size of the ring. The jewelry is marked with the hallmark of the Czech Assay Office in accordance with Act No. 539/92 Coll. on Assaying and Testing of Precious Metals. We provide a certificate of authenticity and quality of stones (4C) for all jewelry with diamonds, which states the weight in carats (ct), type of cut, clarity and color of the diamond. The ordered jewelry is handed over to you personally or delivered in an original DeLoire box with an invoice for the total amount of ordered goods.
Delivery time
Normal delivery times for all goods vary depending on the current workload of our workshop.
For wedding rings that we make to order for you, the production time is currently between 5-6 weeks. Exceptionally, the delivery time can be extended by 7 days by our company; a longer period can only be extended for delivery after agreement with you (for example, during production time, overload, etc.). The customer will be informed in good time. Believe that it is also in our interest to deliver the jewelry to you as soon as possible to our mutual satisfaction.
Complaints and warranty
All jewelry purchased through our website are original DeLoire products and are covered by a 24-month warranty. Wedding rings are an exception, as we provide a lifetime warranty for them.
The warranty covers material defects and proven manufacturing defects.
The warranty does not apply to mechanical damage (deformation due to external force), surface damage (scratches) and damage caused by improper use.
The warranty also expires in the event of any intervention in the goods by a third party. In the event of any request for a change or modification of our product (shrinkage, polishing, restoration, etc.)
A defect resulting from incorrect or incomplete data entered by the customer in the order form is not recognized as a reason for a complaint (we advise you to pay increased attention and care when measuring the size of your fingers).
When making a complaint, it is necessary to send the goods at your expense to the address of our establishment and it is necessary to indicate your contact details, product name, description of the defect, date and your signature and delivery notes, warranty certificate, proof of payment accompany the shipment of the goods.
At the same time, please indicate your telephone number and e-mail so that we can contact you flexibly and quickly regarding the status of your complaint.
If any of the above conditions are not met, the defect will not be checked or acknowledged and the goods will be returned to the customer at his expense. If the defect is removable, our company will remove the defect at its own expense in the shortest possible time.
If the defect is irremovable, after consultation with the customer, we offer a discount, exchange of the defective goods for a new or different product or a cash refund in the store or deposit of the relevant amount into the account specified by the customer. Our company ensures that complaints are handled in the shortest possible time. However, it reserves the right to use the statutory 30-day period for handling complaints from the date of receipt. The warranty period is extended by the duration of the complaint procedure.
Withdrawal from the purchase contract
Custom-made goods can only be complained about due to manufacturing defects within the framework of the warranties provided for the individual type of product.
Personal data protection
Our company as the operator declares that all personal information about customers is confidential and is stored in accordance with the applicable laws of the Czech Republic. Access to the data is provided only to employees of our company. The company undertakes not to provide personal data about customers to third parties.
